NETWORK AND MACHINE RESOURCES

Clarity reserves the right to monitor and allocate network and machine resources. IP addresses are allocated per server and virtual server specifications. Cgi resources are allocated one per domain (a virtual host is required for each cgi-bin and is considered a virtual host). Clarity reserves the right to discontinue any script which may cause excessive server load.

 

SYSTEM AND NETWORK SECURITY
Violations of system or network security are prohibited, and may result in criminal and civil liability. Clarity will investigate incidents involving such violations and may involve and cooperate with law enforcement authorities if a criminal violation is suspected. Clarity respects the privacy of customer data and vigilantly protects that data and ALL customers who host with Clarity. If any violation of the law or this policy is suspected, Clarity reserves the right to investigate. Use of the Clarity network constitutes consent to monitoring. Examples of unlawful acts, system, or network security violations include, without limitation, the following:
Unauthorized access to or use of data, systems or networks, including any attempt to probe, damage, scan or test the vulnerability of a system or network or to breach security or authentication measures without express authorization of the owner of the system or network. Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner of the system or network. Interference with service to any user, host or network including, without limitation, mailbombing, flooding, deliberate attempts to overload a system and broadcast attacks. Unauthorized access to any data, system, or network from an unauthorized system or network for any purpose which is not lawful or which is intended to do harm. Forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting. Electronic forging of any kind to include but not limited to IP addresses, domains, business names, etc.

 

EMAIL

Sending unsolicited mail messages, including, without limitation, unwanted advertising and informational announcements, is explicitly prohibited. A user shall not use another site's mail server to relay mail without the express permission of the site owner. Legitimate mailing lists and subscriber lists are acceptable. Otherwise, it is spam.

 

USENET

Posting the same messages to multiple newsgroups (excessive cross-posting or multiple-posting, also known as "SPAM") is expressly prohibited.

For Example:
If you are hosting a bulk email site on Clarity servers and you use another ISP to SPAM from in order to reference your Clarity site by IP address or domain name, you are violating Clarity policy and possibly the law.
If you have been granted telnet access to Clarity servers, multiple telnet log-ons are strictly prohibited and you must come from a valid IP address. Forgery is against the law.
Any type of denial of service attack from valid or invalid addresses is a violation of Clarity security policy and against the law.
If you have been granted password privileges for FTP or telnet, sharing your password with an unauthorized user or third party is strictly prohibited.

When Will Clarity Disclose My Information to Third Parties?
Disclosure to Successors. We may disclose your Personal Information to any successor-in-interest of ours, such as a company that acquires us. In the event Clarity goes through a business transition, such as a merger or acquisition by or with another company, or sale of all or a portion of our assets, your Personal Information will likely be among the assets transferred. Disclosure to Third Party Service Providers and Online Partners. We may contract with various third parties who help us provide, maintain and improve the Website and the Clarity Services. For example, we use a third party to process payments made to us, and may subcontract out production, fulfillment, analytics, reporting or other operations. We also contract with several online partners to help manage, monitor and optimize our Website and the Clarity Services and to help us measure the effectiveness of our advertising, communications and how visitors use the Website. We will use commercially reasonable efforts to prevent such third parties from disclosing your Personal Information, except for the purpose of providing the services in question. We cannot guarantee that such third parties will not disclose your Personal Information. Clarity does not share, rent or trade your Personal Information with third parties for their promotional purposes.

 

Disclosure to Shopkeepers. If you purchase a product from a Shop, Clarity may provide your name, and the city and state information provided by you to the Shopkeeper. In the Shopkeeper Agreement, Clarity contractually obligates each Shopkeeper not to use or disclose this information for any purposes other than internal record keeping, and for marketing their Shops, only if you have opted in to receive marketing material directly from the Shopkeeper. We cannot guarantee all Shopkeepers will comply with this obligation.

Disclosure of Non-Personal Information. We will disclose Non-Personal Information, in aggregate form, to potential strategic partners, advertisers, investors, customers, and others. You may not opt-out of the sharing of this information. However, it cannot be easily used to identify you personally.

 

What About Cookies and Web Beacons?

Website Content. The content that you store, post, or transmit on or through the Website, such as message board postings, storefront pages, and images on your Products, may be accessed by other users, including people that you do not know. Tell-A-Friend
If you choose to use our referral service to tell a friend about the Website or the Clarity Services, we will ask you for your friend's name and legal@claritybringsserenity.com. We will automatically send your friend a one-time email inviting him or her to visit the Website. We store this information for the sole purpose of sending this one-time email and tracking the success of our referral program.
